So even while the MLS stats keep showing a season adjustment to lower numbers, the total Fippers in Trouble keeps growing. This week I show it is up 6 from last week, or a 1% gain. What is going to happen in the spring, when sellers have to get serious.

Max, there has been a lot of mortgage fraud going on, particularly with the Fippers in Trouble homes. I see on your blog that MLS 60128809 was a funny money 2005 purchase, possibly even a little cash out at close of escrow? 1104 Southbridge in Lincoln. Hmmm. Now the lender has foreclosed and the listed price is $574,900, substantially less than the $687,000 in loans the Flipper received in 2005.

In a bit of irony, the lender is listed as Own It Mortgage Solutions. Well, now they own it! I guess that is their solution. This lender must have been underwritten by HSBC Bank, because that is who stepped up to foreclose and take title.

And what will happen to the Flipper who bailed on the property? She will not get to keep any funny money. She received an 80/20 financing plan. The 20% top loan is recourse. So not only does she have a foreclosure on her credit, she will have a $125,000 judgment to pay off, before she buys her next car or applies for another credit card. Hmmm, do I see a bankruptcy in the future....Oh wait, those don't work anymore either. Can you spell indentured servitude?

It keeps getting curioser and curioser out there.

I was talking to an appraiser on Thursday who said the FBI has tripled their staff to handle all the mortgage fraud cases. They are looking to prosecute the sellers now, who are signing the false escrow statements for higher purchase prices and rebating to the cash out to the buyers. This may include a lot of homebuilders if the rebate exceeds 3% of the loan amount. Watch out below....the lenders have more Philadelphia lawyers than the homebuilders!

See how fast greed can turn to fear when the FBI is on your tail.

I can tell you that the FBI is buffeted by the same political winds that move everything else in DC. If/when this scandal starts effecting national politics, the FBI doesn't want to be accused of inaction like after 9/11.

Readers of this and similar blogs know the horse has already left the barn on the national mortgage scandal. But it's never too late for CYA.

Mortgage fraud is running rampant. That is great news to hear JR about the FBI increasing staff. If you notice any funny mortgage scams, how do you let the FBI know. Can you send something anonymous.

These fly by night mortgage outfits are run by some of the greatest idiots that have ever lived. Their perception of mortgage fraud is every one is doing it, it must be ok. In addition, I think their are a lot of home run mortgage companies that are either lying about loans when they sell them off or are coaching the applicant how to scam the loan. They will resort to anything to get the commission. I am floored how regulated banks are, but subprime can bull crap their way through anything.

I mean what the hell, a bank has to have highly qualified individuals in management or they will get burned, sub prime they can take a loser who has criminal intentions and run a multi-million dollar loan operation.

The FBI has a lot of work, next congressional hearings, next new laws i.e. SArbanes Oaxley, but the mortgage scams affecting this nation are going to make ENRON and WORLDCOM look like cup cakes.

If you notice any funny mortgage scams, how do you let the FBI know. Can you send something anonymous.

I would say, if you have some kind of insider knowledge (i.e. you work for a company you know is committing fraud), try and secure some physical evidence, and call the FBI immediately.

OTOH, if you merely suspect fraud, I would hold off. I think if you try and contact the FBI too much, they'll dismiss you as a crank.

This might be a subject worthy of its own blog post. Let me do some research...
